Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Quarry, the website builder available at quarry.ink (the “Service”), operated by Quarry (“we”, “us”, “our”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
Quarry lets you create and publish a website to showcase your work, accept booking inquiries, and optionally sell items through an online catalog. Subscriptions are offered on Basic and Pro plans.
Payments are processed by Stripe. We do not store full payment card details.
2. Accounts and Eligibility
You must be able to form a binding contract to use the Service, and you are responsible for the accuracy of the information you provide.
You are responsible for safeguarding your account credentials and for all activity that occurs under your account. Notify us promptly of any unauthorized use.
3. Subscriptions, Free Trial, and Billing
Paid plans are billed in advance on a recurring basis through Stripe. Where a free trial is offered, your paid subscription begins automatically when the trial ends unless you cancel before then.
Subscriptions renew automatically for successive periods until cancelled. You may cancel at any time; your access continues until the end of the current paid period.
We may change plan pricing or features. We will give reasonable notice of price changes, and they take effect on your next renewal. Fees are non-refundable except as described in our Refund Policy.
4. Acceptable Use
You agree not to use the Service to publish unlawful, infringing, deceptive, or harmful content, to violate the rights of others, or to interfere with or attempt to gain unauthorized access to the Service or its systems.
You are solely responsible for the content you publish and for ensuring you have the rights to use it.
5. Your Content
You retain ownership of the content you upload or create. You grant us a worldwide, non-exclusive licence to host, store, reproduce, and display that content solely to operate and provide the Service.
You are responsible for maintaining your own copies of your content.
6. Payments Between You and Your Clients
If you enable payments or catalog sales, transactions are processed through Stripe Connect. The contractual relationship for those sales is between you and your client.
You are responsible for fulfilling your offerings, for any taxes arising from your sales, and for handling your clients’ refund and dispute requests. Quarry provides the platform and is not a party to those transactions.
7. Intellectual Property
The Service, including its software, design, and trademarks, is owned by Quarry and protected by law. These Terms do not grant you any right to our intellectual property except the limited right to use the Service as permitted here.
8. Suspension and Termination
You may stop using the Service and close your account at any time. We may suspend or terminate access if you breach these Terms, if required by law, or to protect the Service or its users.
On termination, your right to use the Service ends. Sections intended to survive termination (such as content licence limitations, disclaimers, and limitation of liability) continue to apply.
9. Disclaimers
The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted or error-free.
10. Limitation of Liability
To the maximum extent permitted by law, Quarry will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, or data. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the twelve months before the event giving rise to the claim.
11. Indemnification
You agree to indemnify and hold Quarry harmless from claims, damages, and expenses arising from your content, your use of the Service, or your breach of these Terms.
12. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will update the “Last updated” date and, where appropriate, notify you. Your continued use of the Service after changes take effect constitutes acceptance.
13. Governing Law and Disputes
These Terms are governed by general principles of contract law applicable to online services. Where a dispute cannot be resolved informally, the parties agree to seek resolution in good faith before pursuing other remedies.
